1. Introduction

Wavelandia ("we," "our," or "us") is a community-driven platform built for surfers to share photos, videos, and stories. We respect the intellectual property rights of others and expect our users to do the same.

In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have adopted the following policy concerning copyright infringement on the Wavelandia platform.

2. Reporting Copyright Infringement (Takedown Notices)

If you are a copyright owner (or authorized agent) and believe that content on Wavelandia infringes your copyright, you may submit a DMCA Takedown Notice to our designated agent.

Your notice must include the following (as required by 17 U.S.C. §512(c)(3)):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed (or a representative list)
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., direct URL to the post)
  • Your name, mailing address, telephone number, and email address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

3. Submit Your Takedown Notice to Our Designated Agent

We will promptly investigate and, if appropriate, remove or disable access to the allegedly infringing material. We may notify the user responsible and provide them an opportunity to submit a counter-notice.

4. Submitting a Counter-Notification (User Appeal)

If you believe that your content was removed in error or misidentification, you may send us a counter-notification under 17 U.S.C. §512(g)(3).

Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the content that was removed (or to which access was disabled) and the location where it appeared before it was removed
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
  • Your name, address, telephone number, and email address
  • A statement that you consent to the jurisdiction of the federal court in your district (or if outside the U.S., the jurisdiction of any U.S. district court), and that you will accept service of process from the person who submitted the original DMCA complaint

5. Repeat Infringers

In accordance with the DMCA and other applicable laws, Wavelandia has a policy of terminating, in appropriate circumstances and at our sole discretion, users who are repeat infringers of intellectual property rights.

6. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing, or that material was removed by mistake, may be subject to liability. Please be honest and accurate in your submissions.
