1. Acceptance of Terms
By accessing or using Wavelandia, you agree to comply with and be bound by these Terms of Service (“ToS”). If you do not agree to these terms, you must not use Wavelandia.
2. Eligibility
You must be at least 17 years old to use Wavelandia. By using Wavelandia, you represent and warrant that you meet this eligibility requirement.
3. Account Registration
To access certain features of Wavelandia, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process.
You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.
4. User Content
You retain ownership of any content you post, upload, or otherwise contribute to Wavelandia (“User Content”).
By submitting User Content, you grant WAVELANDIA LLC a worldwide, royalty-free, non-exclusive, and transferable license to use, reproduce, modify, publish, and distribute such content in any media, including the right to display your images on Wavelandia.
You are solely responsible for your User Content and any consequences of posting it. WAVELANDIA LLC does not endorse or assume responsibility for any User Content, including content that may infringe upon third-party intellectual property rights.
5. Prohibited Conduct
You agree not to:
- Post any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
- Engage in any form of sexual or inappropriate conduct on Wavelandia.
- Use Wavelandia to harass, abuse, or harm another person or group.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the security, integrity, or performance of Wavelandia.
6. Intellectual Property Rights
All content on Wavelandia, including text, graphics, logos, and software, is the property of WAVELANDIA LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not use, reproduce, or distribute any content from Wavelandia without express written permission from WAVELANDIA LLC.
7. Digital Millennium Copyright Act (DMCA)
Wavelandia respects the intellectual property rights of others and expects users of the platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have adopted a policy to address claims of copyright infringement involving content uploaded to our platform.
If you believe that any content on Wavelandia infringes your copyright, you may submit a formal takedown notice in accordance with our DMCA Policy.
We reserve the right to remove content in response to valid DMCA notices and, where appropriate, to terminate the accounts of repeat infringers.
8. Termination
WAVELANDIA LLC reserves the right to suspend or terminate your access to Wavelandia at any time, without notice, for any reason, including if you violate these Terms of Service.
9. Disclaimers
Wavelandia is provided “as is” and “as available” without warranties of any kind, either express or implied. WAVELANDIA LLC does not warrant that the service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, WAVELANDIA LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of Wavelandia or any content therein.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Pennsylvania, United States. Any disputes shall be resolved in the courts located in Pennsylvania.
12. Changes to the Terms
WAVELANDIA LLC may modify these Terms of Service at any time. Your continued use of Wavelandia after changes are posted constitutes your acceptance of the revised terms.
